1. Protection of Personal Data

We, the notary office Brix Mayer Hoheneck Thierrichter, process your personal data exclusively where you have given your consent, for the performance of the mandate or engagement you have given us for the purposes agreed with you, or where another legal basis (within the meaning of the GDPR) exists. Only such personal data are collected as are necessary for the performance and handling of our notarial tasks and services or as you have voluntarily provided to us.

2. Your Right to Information and Erasure (Data Subject Rights)

You have the right to information about your stored personal data, their origin and recipients and the purpose of the data processing, as well as a right to rectification, objection, data portability, restriction of processing and blocking or erasure of inaccurate or unlawfully processed data. Restrictions may arise from the notary's duty of confidentiality pursuant to section 37 of the Notarial Profession Act (NO).

You also have the right to withdraw any consent you may have given to the use of your personal data at any time. To exercise your data subject rights (information, erasure, rectification, objection and/or data portability), please contact the notary office specified in the letterhead.

If you are of the opinion that the processing of your personal data by us violates applicable data protection law or that your data protection rights have been infringed in any other way, you may lodge a complaint with the competent supervisory authority. In Austria, this is the Data Protection Authority (Datenschutzbehörde).

3. Use of Data – Security

The data provided to us are not processed for purposes other than those defined by the mandate agreement, by your consent or otherwise by a provision in accordance with the GDPR. Excepted from this is use for statistical purposes, provided the data made available have been anonymised.

We have taken state-of-the-art organisational and technical measures to ensure the protection of your personal data (protection against misuse both from within and from outside, for example through firewalls, encryption, access authorisations, etc). However, it cannot be ruled out that information may be viewed or used by other persons as a result of errors in data transmission not caused by us or through unauthorised access by third parties (hackers, etc). We accept no liability for this, unless such misuse was culpably caused by us.

4. Disclosure of Data to Third Parties (Transfer)

As a matter of principle, we do not make your personal data available to others. However, in order to fulfil your engagement or for legal reasons, it may be necessary to pass your data on to third parties. These may be courts, authorities, legal representatives or other involved third parties (including processors acting on our behalf). In such cases, your data are disclosed exclusively on the basis of the GDPR (on the basis of the consent you have given, the performance of a contract, compliance with a legal obligation, etc).

As notaries and within the scope of the notarial field of activity, we also regularly obtain information about you from third parties.

We also point out that we may transfer your personal data to recipients (see above) outside your country. However, we transfer your personal data only and exclusively on the basis of the GDPR (an adequate level of data protection or the implementation of measures to ensure that all recipients have an adequate level of data protection).

5. Storage/Erasure of Data

We do not retain your personal data longer than is necessary for the purposes for which they are processed. Data are also retained for evidentiary purposes, taking into account limitation periods or for as long as claims (liability) may be asserted against us.

6. Cookies

Our website uses cookies. These are small text files that are stored on your device with the help of your browser. We use cookies to make our services user-friendly. Some cookies may remain stored on your device until you delete them. They enable us to recognise your browser on your next visit. If you do not wish this, you can set up your browser so that it informs you when cookies are set and you allow them only in individual cases. If cookies are deactivated, the functionality of our website may be limited.

7. Web Analysis/Server Log Files

The provider of this website automatically stores information in so-called server log files, which are automatically transmitted by your browser. This includes your IP address, browser and language settings, operating system, your internet service provider, date/time and URL. All of this serves to optimise the website in terms of user-friendliness and the provision of useful information about our services. These data are not merged with personal data sources.
